Agricon Equipment (Private) Limited (hereon referred to as Agricon) has created this Privacy Policy to demonstrate its firm commitment to privacy. This Privacy Policy describes how Agricon collect, use, store, make available, disclose, update, safeguard, destroy or otherwise deal with (process) your personal identifiable information and to explain your rights relating to the privacy of your personal identifiable information and how the law protects you. In compliance with the Cyber & Data Protection Act [Chapter 12:07] (hereon referred to as the CDPA) and Statutory Instrument 155 of 2024, (hereon referred to as the Regulations)including transparency, accountability, and choice regarding the collection and use of your personal information Agricon follows the policy as stated below:

Processing means broadly anything done with the Personal Identifiable Information, including collection, usage, storage, dissemination, modification, or destruction (whether such processing is automated or not).

What are our obligations

Some of the obligations under the CDPA and the Regulations are to collect and/or process personal identifiable information:

in accordance with the right to privacy of the data subject;
lawfully, fairly and in a transparent manner in relation to any data subject;
for explicit, specified, and legitimate purposes and not further processed in a manner incompatible with the communicated purpose;
adequately and in a manner that is limited to what is necessary in relation to the purposes for which it is processed;
only where a valid explanation is provided;
accurately and, where necessary, kept up to date, with every reasonable step being taken to ensure that inaccurate personal data is erased or rectified without delay.

What are your rights

We value your trust and also want you to be familiar with your rights under the legislation and to know how you can exercise them in your interaction with Agricon.

You have a right to:

access the personal information we hold about you and to correct and update your information;
object to our processing your personal information, where applicable;
request that we delete/forget your personal information where appropriate;
be notified that your personal information is being collected by us or has been accessed or acquired by an unauthorised person;
object to the processing of personal information for the purposes of direct marketing;
not be subject to automated decision-making processes in respect of an application for products and/or services, except under certain circumstances; and
to request reasons or make a representation to us if your application for products and/or services is refused.

Collection and Use of Personal and Non-Personal Information

In compliance with applicable law, Agricon collects information from different points on its sites and is the sole owner of the information collected.

Agriconmay collect and store the following personal information, or any other information specified in this Privacy Policy:

Contact information, such as; your name, email address, and other information that you provide by filling out our web forms; this includes information provided at the time of registering, posting material, or requesting services

Unique identifiers, such as username or password

Agricon also collects the following non-personal information, however, some of which is classified as sensitive data under the CDPA and Regulations:

Correspondence with other users, blogs, or social media platforms that you send through Agricon and correspondence sent to Agricon.

As is true of most websites, Agricon automatically gathers information about your computer, such as your IP (Internet Protocol) address, browser type, referring/exit pages, and operating system.

This may also include information collected from surveys or contests, which may include contact information and demographic information. You may at several different points on the Agricon website request information (e.g., how to become an advertiser, or how to become a member). Testimonials

Agricon posts customer testimonials that may contain personally identifiable information, such as the customer’s name. Agricon obtains customer consent to post names prior to posting the testimonial. Log Files

Agricon uses your IP address to help diagnose server problems, and to administer our website. Agricon uses your IP addresses to analyse trends and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.

Every time you access Agricon website, some data is temporarily stored and processed in a log file, such as anonymous IP addresses, the browser types, the recalled page, or the date and time of the recall. The data that Agricon collects from you is transferred and stored on local servers in Zimbabwe. The data may also be processed by partners operating outside of Zimbabwe, who work for Agricon or one of its suppliers. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details, and the provision of support services. Agricon will take all steps reasonably necessary to ensure that your data istreated securely and in accordance with this Privacy Policy and all applicable data protection laws.

Where Agricon has given you (or where you have chosen) a password that enables you to access certain parts of the site, you are responsible for keeping this password confidential. Agricon has a companywide commitment to your privacy. Agricon emails will only come from this domain. Agricon does not permit our employees to send or receive work-related emails from personal accounts or any other address. Do not share your username or password with anyone.

Additional Policy Information

Agricon website includes widgets, which are interactive mini programs that run on Agricon website to provide specific services from another company (e.g., displaying the news, opinions, music, etc). Personal information, such as your email address, may be collected through a widget. Cookies may also be set by a widget to enable it to function properly. Information collected by this widget is governed by the Privacy Policy of the company that created it.

Updating/Accessing/Amending/Correcting Personally Identifiable Information

If your personally identifiable information changes, or if you no longer desire Agricon services, you may correct, update, amend, delete/remove, or deactivate it by making the change on the member information page for Agricon Equipment (Private) Limited, or by emailing zimbabwe@agriconequipment.net, or by contacting Agricon via telephone (+263 8677 00 45 49). Agricon Customer Support is available Monday through Friday, 9 a.m.–4 p.m. Users have a right to access, object to, or oppose, for legitimate reasons, the processing of their personal data in accordance with this Privacy Policy. Agricon will respond to your request to access within 30 days.

Note to Parents or Guardians

Minors may want to visit Agricon on the Internet. However, the site is not directed at children under the age of 18, and those under the age of 18 should not provide personal data on the site unless they have received permission from their parents before submitting any personal information. Agricon believes parents should be responsible for supervising the online activities of their children and consider various tools that allow them to provide their children with a controlled, child-friendly Internet. These tools are designed to preclude children from releasing personal information online without the permission of their parents. If Agricon becomes aware that a minor has submitted information on its site, Agricon reserves the right to request proof that the parent or guardian has permitted use by the minor of the site, otherwise Agricon reserves the right to delete the relevant information and the minor’s registration on the site.
